IMPORTANT — PLEASE READ THIS REFUND AND CANCELLATION POLICY CAREFULLY BEFORE PURCHASING OR SUBSCRIBING TO ANY PTAL SERVICE. BY SUBMITTING PAYMENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THIS POLICY IN ITS ENTIRETY. ALL SALES ARE FINAL. NO REFUNDS WILL BE ISSUED UNDER ANY CIRCUMSTANCES EXCEPT AS EXPRESSLY REQUIRED BY APPLICABLE LAW.

THIS POLICY IS INCORPORATED BY REFERENCE INTO PTAL'S TERMS AND CONDITIONS OF SERVICE AND MEMBER AGREEMENT, BOTH OF WHICH GOVERN YOUR USE OF THE PTAL PLATFORM AND SERVICES. IN THE EVENT OF ANY CONFLICT BETWEEN THIS POLICY AND THOSE DOCUMENTS, THIS POLICY SHALL CONTROL WITH RESPECT TO REFUND AND CANCELLATION MATTERS.

Section 1. Overview and Scope

This Refund and Cancellation Policy ("Policy") is published by Precise Trading Analytics, LLC, a Michigan limited liability company ("PTAL," "we," "us," or "our"), and governs all purchases of, and subscriptions to, PTAL's services, platform access, and digital products by members and subscribers ("Member" or "you").

This Policy applies to all transactions conducted through www.precisetradinganalytics.com and any affiliated platform or payment system used by PTAL. By completing any purchase or subscription enrollment with PTAL, you agree to be bound by this Policy in its entirety. This Policy is incorporated by reference into PTAL's Terms and Conditions of Service and Member Agreement, and should be read in conjunction with those documents.

If you do not agree with this Policy, you must not purchase or subscribe to any PTAL service. Your submission of payment constitutes your irrevocable acceptance of this Policy.

Section 2. Description of Services Subject to This Policy

This Policy applies to all PTAL products and services, including without limitation:

  • Access to PTAL's proprietary market scanning system and real-time scanner tools;
  • Access to PTAL's trade alert and notification system;
  • Access to PTAL's personal trading library, including educational content, video materials, research archives, and analytical resources;
  • Access to any PTAL member portal, dashboard, or platform features;
  • Access to any PTAL newsletter, publication, or market commentary service; and
  • Any other digital product, subscription service, or platform access offered by PTAL now or in the future.

Because all PTAL services consist of digital content and platform access that is made immediately available to Member upon payment, all sales are final as set forth in Section 3 of this Policy.

Section 3. All Sales Final — No Refund Policy

ALL SALES ARE FINAL. PTAL DOES NOT ISSUE REFUNDS OF ANY KIND, FOR ANY REASON, ON ANY SUBSCRIPTION FEES, ACCESS FEES, OR OTHER CHARGES ONCE PAYMENT HAS BEEN PROCESSED AND ACCEPTED. THIS POLICY APPLIES TO ALL PTAL PRODUCTS AND SERVICES WITHOUT EXCEPTION, EXCEPT ONLY AS EXPRESSLY REQUIRED BY APPLICABLE LAW AS SET FORTH IN SECTION 14.

Member expressly acknowledges and agrees that:

  • All monthly subscription fees charged to Member's designated payment method are earned in full by PTAL upon the commencement of each billing cycle, regardless of whether Member actually accesses or uses the Services during that billing cycle;
  • No refund, credit, proration, set-off, or other adjustment will be issued for any billing period in which a charge has been successfully processed, regardless of the reason for any cancellation or non-use;
  • The nature of PTAL's Services — consisting of digital platform access, real-time scanner tools, alert systems, and proprietary digital content — renders such services non-returnable and non-refundable once access has been granted;
  • Member has had the opportunity to review this Policy prior to purchase and has made an informed decision to subscribe with full knowledge of and agreement to PTAL's no-refund policy; and
  • Member's decision to not use or under-use the Services during any billing period does not entitle Member to any refund, credit, or other adjustment.

BY SUBMITTING PAYMENT TO PTAL, MEMBER IRREVOCABLY WAIVES ANY CLAIM TO A REFUND OF ANY SUBSCRIPTION FEE OR OTHER CHARGE PROCESSED BY PTAL, EXCEPT ONLY AS EXPRESSLY REQUIRED BY APPLICABLE LAW. THIS WAIVER IS A MATERIAL TERM OF THE AGREEMENT BETWEEN MEMBER AND PTAL AND IS A FUNDAMENTAL BASIS UPON WHICH PTAL PROVIDES THE SERVICES.

Section 4. Monthly Billing Cycle Explained

PTAL's subscription services are billed on a monthly recurring basis. The following terms govern Member's billing cycle:

4.1 Billing Date

Member's billing cycle commences on the date Member first successfully enrolls in and pays for a PTAL subscription ("Billing Date"). Thereafter, Member's designated payment method will be automatically charged the applicable monthly subscription fee on the same calendar date each month (or the nearest available date if the Billing Date falls on a date that does not exist in a given month, such as the 31st), until Member's subscription is cancelled in accordance with Section 5 of this Policy.

4.2 Charges Are Final Upon Processing

Each monthly subscription fee is charged to Member's designated payment method at the commencement of each new billing cycle. Once a monthly charge has been successfully processed and accepted, that charge is final, non-refundable, and non-reversible under any circumstances, except only as expressly required by applicable law. There are no partial months, partial refunds, or pro-rated adjustments of any kind.

4.3 Access Granted Upon Payment

Member's access to the Services for each billing period is granted immediately upon successful processing of that period's subscription fee. Because PTAL's platform, scanning tools, alert system, and trading library are digital services made immediately available to Member upon payment, each monthly charge is considered fully earned by PTAL at the moment access is granted for that billing period.

4.4 No Mid-Cycle Adjustments

PTAL does not issue mid-cycle refunds, credits, or adjustments under any circumstances. If Member cancels their subscription at any point during a billing cycle, Member will retain access to the Services through the end of the then-current, fully paid billing period, and no portion of that period's subscription fee will be refunded. See Section 6 and Section 7 for the full effect of cancellation.

Section 5. How to Cancel Your Subscription

5.1 Cancellation Methods

Member may cancel their PTAL subscription at any time using either of the following methods:

  • Online Self-Service: By logging into Member's Account on the PTAL platform, navigating to the "Subscriptions" or "Account Settings" section of the Member Dashboard, and following the on-screen cancellation prompts; or
  • Written Email Request: By submitting a written cancellation request to PTAL via email at info@precisetradinganalytics.com. The email must include Member's full name, the email address associated with Member's Account, and a clear statement of Member's intent to cancel. Email cancellation requests are not effective until Member receives a written confirmation of cancellation from PTAL.

5.2 Cancellation Methods Not Accepted

PTAL will not accept, honor, or process cancellation requests submitted by any of the following methods:

  • Telephone or verbal request of any kind;
  • Text message, direct message, or social media communication;
  • Facsimile or postal mail; or
  • Any request submitted through a third party, including any payment card issuer or financial institution.

CANCELLATION REQUESTS SUBMITTED BY ANY METHOD OTHER THAN THOSE EXPRESSLY SET FORTH IN SECTION 5.1 WILL NOT BE ACCEPTED OR PROCESSED.

5.3 Cancellation Deadline to Avoid Next Month's Charge

To avoid being charged for the next monthly billing cycle, Member's cancellation must be submitted and confirmed by PTAL at least twenty-four (24) hours before Member's next scheduled Billing Date.

5.4 Cancellation Confirmation

Upon receipt and processing of a valid cancellation request, PTAL will send a written confirmation of cancellation to the email address associated with Member's Account within five (5) business days.

Section 6. Effect of Cancellation

Upon the effective processing of a valid cancellation request by PTAL, the following shall apply:

  • Member's subscription will not renew at the end of the then-current, fully paid billing cycle;
  • No further monthly charges will be assessed against Member's designated payment method following the end of the then-current billing cycle;
  • Member will not receive any refund, credit, or pro-rated adjustment for any portion of the then-current billing cycle;
  • All subscription fees charged prior to and including the then-current billing cycle are final, fully earned, and non-refundable; and
  • Member's obligations under PTAL's Terms and Conditions and Member Agreement that are expressly stated to survive termination shall remain in full force and effect following cancellation.

Section 7. Access Following Cancellation

Following PTAL's processing of a valid cancellation request, Member's access to the Services shall continue through the last day of the then-current, fully paid monthly billing cycle. Specifically:

  • Member will retain full access to PTAL's scanner system, alert system, trading library, and all other platform features through 11:59 PM Eastern Time on the last day of the then-current billing period;
  • Upon the expiration of the then-current billing period, Member's access to all Services will be immediately and automatically terminated without further notice;
  • PTAL reserves the right to immediately deactivate Member's Account and delete all Member Content and data associated with Member's Account upon expiration of the final billing period; and
  • Member is solely responsible for preserving and exporting any personal notes, watchlists, settings, or other data or content stored in Member's Account prior to the expiration of Member's final billing period.

ONCE MEMBER'S ACCESS TO THE SERVICES IS TERMINATED FOLLOWING CANCELLATION, PTAL HAS NO OBLIGATION TO RESTORE ACCESS OR RECOVER ANY DATA, CONTENT, OR ACCOUNT INFORMATION.

Section 8. PTAL-Initiated Cancellation or Termination

8.1 Termination for Convenience by PTAL

PTAL reserves the right to cancel or terminate any Member's subscription, or to discontinue the Services entirely, for any reason or no reason, upon thirty (30) calendar days' advance written notice. In the event of termination by PTAL for convenience, PTAL will provide Member with a pro-rated credit or refund for any prepaid subscription fees attributable to the unused portion of the then-current billing period. This is the sole circumstance under which PTAL will issue any refund or credit.

8.2 Termination for Cause by PTAL

PTAL reserves the right to immediately suspend or terminate Member's subscription and access to the Services, without prior notice and without any refund or credit of any kind, upon the occurrence of any of the following:

  • Member's breach of any term of PTAL's Terms and Conditions, Member Agreement, or this Policy;
  • Member's initiation of any chargeback, payment dispute, or reversal request in violation of Section 10;
  • Member's engagement in any prohibited conduct;
  • Any fraudulent, unlawful, or abusive use of the Services by Member;
  • Any act or omission by Member that creates a legal, regulatory, reputational, or business risk for PTAL; or
  • Any investigation or proceeding involving Member by any securities regulatory authority, law enforcement agency, or governmental body.

IN THE EVENT OF TERMINATION FOR CAUSE BY PTAL, NO REFUND, CREDIT, PRO-RATION, OR OTHER ADJUSTMENT OF ANY KIND WILL BE ISSUED.

Section 9. Termination for Breach — No Refund

If PTAL terminates Member's subscription or access to the Services as a result of Member's breach of any provision of PTAL's Terms and Conditions, Member Agreement, or this Policy, Member shall not be entitled to any refund, credit, or other adjustment of any subscription fees or charges previously paid.

Section 10. Chargebacks and Payment Disputes

MEMBER EXPRESSLY AGREES NOT TO INITIATE ANY CHARGEBACK, PAYMENT REVERSAL, OR DISPUTE WITH MEMBER'S PAYMENT CARD ISSUER, BANK, OR ANY OTHER FINANCIAL INSTITUTION WITH RESPECT TO ANY CHARGE MADE BY PTAL, UNLESS MEMBER HAS FIRST: (A) NOTIFIED PTAL IN WRITING OF THE DISPUTED CHARGE AT INFO@PRECISETRADINGANALYTICS.COM; AND (B) AFFORDED PTAL THIRTY (30) CALENDAR DAYS TO INVESTIGATE AND RESPOND TO THE DISPUTE.

In the event Member initiates an unauthorized chargeback or payment dispute, PTAL reserves the right to immediately suspend or permanently terminate Member's access to the Services without notice and without any refund, contest the chargeback, refer Member's account to a collections agency, pursue all available legal remedies, and permanently ban Member from re-subscribing to any PTAL service.

Section 11. Failed or Declined Payments

In the event that any monthly subscription charge is declined or fails to process for any reason, PTAL will attempt to notify Member via email. A declined payment fee of thirty United States dollars (USD $30.00) will be assessed for each payment that is declined for any reason. Member's access to the Services will not be restored following a payment failure until all outstanding fees have been paid in full.

Section 12. Price Changes

PTAL reserves the right to modify its subscription pricing at any time. In the event of a price increase applicable to existing active subscribers, PTAL will provide at least thirty (30) calendar days' advance notice via email before the price change takes effect. If Member does not agree to a price change, Member's sole remedy is to cancel their subscription in accordance with Section 5 before the effective date of the price change.

Section 13. Michigan Consumer Protection Disclosure

PTAL is a Michigan limited liability company and this Policy is governed by the laws of the State of Michigan. In compliance with applicable Michigan law, PTAL makes the following disclosures:

  • This Policy and its no-refund terms are clearly and conspicuously disclosed to all prospective Members prior to the completion of any purchase;
  • Member's agreement to this Policy is obtained through an affirmative acceptance mechanism at the point of purchase;
  • PTAL's no-refund policy applies uniformly to all Members;
  • Member's statutory rights under applicable Michigan law, to the extent they cannot be waived by contract, are preserved by Section 14; and
  • Any Member who believes PTAL has violated the Michigan Consumer Protection Act may file a complaint with the Michigan Attorney General's Consumer Protection Division at www.michigan.gov/ag.

Section 14. Exceptions Required by Law

Notwithstanding any other provision of this Policy, PTAL will issue a refund only to the extent specifically required by applicable federal, state, or local law that cannot be waived by contract. Members who believe they may be entitled to a refund under applicable law should contact PTAL in writing at info@precisetradinganalytics.com, identifying the specific law or regulation upon which the refund claim is based.

Section 15. No Waiver

PTAL's failure or delay in enforcing any provision of this Policy on any occasion shall not constitute a waiver of PTAL's right to enforce such provision on any subsequent occasion.

Section 16. Amendments to This Policy

PTAL reserves the right to amend, modify, or replace this Policy at any time. The most current version of this Policy will be posted on the Site. PTAL will use commercially reasonable efforts to notify active Members of any material changes via email at least thirty (30) calendar days prior to the effective date of any material change.

Section 17. Governing Law

This Policy shall be governed by and construed in accordance with the laws of the State of Michigan, United States of America, without regard to its conflict of law principles. All disputes arising out of or relating to this Policy shall be resolved exclusively through binding arbitration in the State of Michigan.
